This Artificial Intelligence Addendum (“Addendum”) supplements and is made part of the Contentstack Master Agreement between Contentstack and Customer governing Customer's use of Contentstack’s Software and/or Services (the "Agreement"). Capitalized terms used but not defined in this Addendum have the same meaning as within the Agreement.

  1. AI Features. "AI Feature(s)" means features, applications, modules, or functionality of the Software (including but not limited to Agent OS, Polaris, Agent Builder, Digital Concierge, AI Assistant, and Brand Kit) that make use of artificial intelligence, generative AI, machine learning, large language models, or similar technologies.
  2. Input and Output. As between Contentstack and Customer, all data, information, content, and materials that Customer inputs, uploads, or connects to the AI Feature, including proprietary brand data fed into Knowledge Vaults (“Input”), and that the AI Feature outputs or generates based on the Input (“Output”) are Customer Data owned by Customer. Customer acknowledges that due to the nature of AI Features, Output provided to Customer may be similar or identical to Output independently provided to and owned by other customers.
  3. AI Providers. AI Features use underlying artificial intelligence, foundational models, or machine learning systems developed and provided by third parties (each, an “AI Provider”). The applicable AI Provider used for the AI Feature will process the Input and provide the Output. 
  4. Restriction on Training. Contentstack will not use Customer Data to develop, train, or improve any general or public AI Features. Contentstack does not permit any AI Provider to use Customer Data to develop, train, or improve any AI Provider's own public artificial intelligence, machine learning, or any other foundational systems or models. 
  5. EU AI Act Classification; Use Restrictions
    1. Regulatory Classification. The use of Contentstack’s Software with AI Features is not designed, intended, or marketed for use as, or as part of, any “high-risk AI system” under Regulation (EU) 2024/1689 (the “EU AI Act”), or any other technology subject to substantially similar obligations under applicable laws or regulations governing the development, provision, or use of AI systems (collectively, a “High-Risk AI System”). As of the effective date of this Addendum, Contentstack’s Software has not been classified as a High-Risk AI System by any competent authority under the EU AI Act or any comparable law. 
    2. High-Risk AI System Use Restriction. Customer agrees that any use of Contentstack’s Software and AI Feature as part of, or in connection with, a High-Risk AI System (including for but not limited to any of the purposes listed in Annex I or Annex III of the EU AI Act) would constitute an exceptional use beyond the scope reasonably contemplated or intended by Contentstack in the design, development, or support of the functionality, and therefore, such use of the Software and AI Feature by Customer is prohibited.
  6. AI Disclaimer. Customer acknowledges and agrees that:
    1. Due to the nature of artificial intelligence, generative systems, and machine learning, information or content generated by AI Features may be incorrect, incomplete, or inaccurate;
    2. The AI Features are not intended as a substitute for human discretion or human decision-making, and Customer is solely responsible for ensuring human oversight, review, and validation in connection with Customer's configuration and use of the AI Features (including the execution of autonomous workflows or workflows powered by AI Agents);
    3. Customer is solely responsible for verifying that the Output is suitable for Customer's intended digital experiences, adheres to compliance requirements, and for all publishing or deployment decisions Customer makes based on the Output; and 
    4. Contentstack shall not be liable to Customer for any and all claims arising out of or in connection with the integration, use or performance of any AI Provider with or in conjunction with Contentstack’s Software and/or Services.
